These Terms and Conditions (“Terms”) apply to your use of the CraftsCity website and marketplace platform (the “Platform”). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Who We Are and How the Marketplace Works
CraftsCity provides an online marketplace where independent sellers (“Vendors”) list products for sale to buyers (“Buyers”). CraftsCity provides the Platform and related tools only.
Unless we clearly state otherwise in writing, CraftsCity is not the seller of products listed on the Platform. Each purchase is a contract directly between the Buyer and the relevant Vendor. Vendors are responsible for their products, including product quality, accuracy of listings, legitimacy, pricing, dispatch, shipping, delivery, returns, refunds, and compliance with applicable laws.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a contract to use the Platform.
If you create an account, you must provide accurate information and keep your login details secure. You are responsible for activity on your account.
3. Orders and Payments
Placing an order is an offer to buy from the Vendor. A binding contract is formed when the Vendor accepts the order.
CraftsCity may facilitate payment through third-party payment providers, but CraftsCity is not the seller of the products and does not control those third-party providers. CraftsCity is not responsible for issues caused by third-party payment services, including delays, processing errors, or service interruptions. 4. Shipping and Delivery
Vendors are responsible for packing, dispatch, shipping method, shipping charges, delivery timeframes, and providing tracking where available. CraftsCity does not ship items unless expressly stated.
CraftsCity is not responsible for delivery delays, lost parcels, damage in transit, failed delivery attempts, customs issues, or courier performance. Any delivery issue should be raised with the Vendor in the first instance.
5. Returns, Refunds and Cancellations
a. Returns, refunds, cancellations, exchanges, and replacements are handled by the Vendor in accordance with the Vendor’s policy and applicable law.
b. Nothing in these Terms limits a Buyer’s mandatory statutory rights under UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where those rights apply, the Vendor remains responsible as the seller for meeting them.
6. Listings, Content and Reviews
a. Product listings, descriptions, images, and other product information are provided by Vendors. CraftsCity does not guarantee that listings are accurate, complete, or up to date.
b. Users may post reviews or other content where enabled. You must not post content that is unlawful, misleading, infringing, abusive, defamatory, or otherwise objectionable. CraftsCity may remove any content or listing, or suspend access to the Platform, where it reasonably considers this necessary to protect the Platform, its users, or its legal position
7. Prohibited Use
You must not use the Platform for unlawful activity, fraud, or misuse. This includes attempting to sell prohibited or counterfeit goods, infringing intellectual property, submitting false information, interfering with Platform security, or attempting to bypass marketplace processes or fees. 8. Intellectual Property
The Platform, including its software, design, branding, and content created by CraftsCity, is owned by or licensed to CraftsCity and protected by intellectual property laws.
Vendors retain ownership of their product content and brand materials. Vendors grant CraftsCity permission to display and use their content on the Platform to operate and promote the marketplace.
9. Disclaimers
The Platform is provided on an “as is” and “as available” basis. CraftsCity does not guarantee uninterrupted or error-free operation. CraftsCity does not make warranties about Vendor products or Vendor performance, including quality, safety, authenticity, legality, or delivery timeframes. Buyers purchase from Vendors at their own discretion, subject to their legal rights.
10. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to the above, CraftsCity is not liable for losses arising from or connected to products sold by Vendors, Vendor acts or omissions, shipping or delivery issues, third-party payment provider failures, or disputes between Buyers and Vendors.
To the fullest extent permitted by law, CraftsCity shall not be liable for any indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of goodwill, or loss of data.
Where CraftsCity is found liable to a user, CraftsCity’s total liability is limited to the greater of fees actually paid by that user to CraftsCity in the 6 months before the event giving rise to the claim.
11. Suspension and Termination
CraftsCity may suspend or terminate access to the Platform if a user breaches these Terms, engages in unlawful conduct, or creates risk to the Platform or other users. 12. Privacy
CraftsCity processes personal data in accordance with its Privacy Policy. Vendors are independently responsible for complying with applicable data protection laws for personal data they receive to fulfil orders.
13. Changes to These Terms
CraftsCity may update these Terms from time to time. Updated Terms will be posted on the Platform with a revised effective date. Continued use of the Platform after changes means you accept the updated Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except where mandatory consumer law allows a consumer to bring a claim in another UK court.
